GTC – General Terms and Conditions (as of July 1st, 2017)

  1. Scope

1.1 The following general terms and conditions (hereinafter referred to as: GTC) apply to all services to be provided by Tanou Energy Work (hereinafter referred to as: Tanou).

1.2 All terms such as customer, (retreat or course) participant, etc. are gender-neutral and refer to both female and male persons.

  1. Services

2.1 Our services result from the service descriptions and the general information in this on our website, as well as from the information relating to the retreat confirmation. Tanou provides services as a course and retreat leader, coach, as a mediator of accommodation and transport options, as well as a guide and travel guide.

2.2 The non-contractual services (accommodation, transport, meals) arranged on behalf of the retreat participants during the retreat with Tanou are not part of the contract. Tanou is therefore not liable for the implementation of these services itself. Any liability is regulated in cases according to the conditions of the mediated company.

  1. Requirements for participation, health information, exclusion

3.1 Participation in the retreat, the courses or exercise units as well as some excursions requires good health. If the participant has cardiovascular problems, lung disease, joint problems or other physical or health problems, it is recommended to consult a doctor before starting or booking the trip or the exercises. The participant should prevent the risk of injury by avoiding excessive strain and jerky movements in the course or exercise unit. Information from Tanou does not constitute medical advice. The participant uses all information independently at his own risk.

3.2 Participation in Qi Gong and yoga exercises does not replace a visit to a doctor, other healing facilities, medication or psychotherapeutic applications. Tanou’s offer excludes all forms of promises of salvation or guarantees of healing. This also applies to the formulations made to present offers. Any interpretations by others are included here.

3.3 Course fees cannot be reimbursed for individual practice hours that the participant does not attend during the retreat. This applies to cases of illness, delay and comparable absences. There is also generally no entitlement to a replacement lesson in another course. There is no general entitlement to part-time participation in the retreat. Course fees will only be reimbursed if the retreat or the lesson (without a replacement date) is canceled by Tanou.

3.4 Tanou expects the participant to respect the manners, customs and laws of the host country. If the participant should violate them, the participant gives Tanou the opportunity to exclude him from the further trip together after a warning in the case of repetition without reimbursement of the travel price. In the event of gross violations (including criminal offenses such as willful bodily harm, threats, theft, drug consumption, excessive alcohol consumption, willful damage to property, etc.), immediate exclusion from the retreat may be considered. Any costs incurred are borne by the customer. The same applies if the customer should unreasonably impair the cooperation in the group.

  1. Registration and payment modalities, conclusion of contract, travel requirements, special right of termination

 

4.1 Registration takes place by email to contact@tanou-energywork.com or tanouenergywork@gmail.com. The registration period ends at the latest one month before the start of the retreat.

If you do not receive a confirmation of registration within 48 hours after registering, please contact Tanou by phone.

4.2 The amount due must be transferred within 7 days to the account specified by Tanou. The booking can only be confirmed after receipt of payment.

4.3 The contract is concluded when the money is received by Tanou on time.

4.4 The retreats generally take place with a capacity of 5 people or more. The maximum number of participants per trip is generally 12 people.

4.5 At the end of the specified registration period up to 8 weeks before the start of the retreat, Tanou has a special right of termination if not enough participants have registered for the retreat or not enough participants have transferred the price within the specified period.

4.6 If Tanou cancels a retreat, an alternative date will be given / agreed. The payment made can also be used as private lessons or for a later retreat if the alternative date is not possible.

4.7 After confirmation of the implementation of the retreat and after receipt of the invoice amount on our account, you can organize your arrival and departure on your own.

  1. Resignation

The following applies to withdrawal from the contract:

Should you not be able to participate in a retreat, please inform me immediately so that a subsequent registration can take the place. In the event of withdrawal in writing no later than 8 weeks before the start of the retreat, 50% of the price will be charged; in the case of later withdrawal and no-show, 100% of the price is due. It is possible to provide a substitute participant. To do this, the substitute participant must register again.

  1. Limitations of Liability

6.1 Participation in the retreat is the responsibility of the customer (see section 3.1) and is excluded in the case of acute or untreated diseases. It is advantageous if the participant informs Tanou of acute or possibly relevant illnesses that are already being treated medically / therapeutically and first obtains the express permission of the attending physician / therapist. However, this is up to each individual and is independent of this and without exception in the full responsibility and liability of the respective participant. The information on this will of course be treated confidentially.

Tanou reserves the right to exclude the participant from participation in case of doubt.

6.2 Liability for defects is excluded if these defects were caused by the participant himself, e.g. by trying to vary or reinvent exercises. The same applies to damage that can be traced back to existing health or physical complaints.

6.3 Tanou assumes no liability for damage to body or health in the context of QiGong, yoga exercises and other sporty, movement-oriented exercises. Each participant has to decide for himself whether one is compatible with his / her physical and mental state. Please ask your doctor in advance if necessary.

Tanou is basically only liable for damages that

(1) Tanou or his legal representatives or vicarious agents have brought about willfully or grossly negligent,

(2) on injury to life, limb or health that is based on a breach of duty by Tanou or one of its legal representatives or vicarious agents.

6.5 In cases other than those mentioned in Section 6.3, Tanou’s liability – regardless of the legal basis – is excluded.

6.6 All unforeseen noises and smells that are related to everyday life in Balinese or Indonesian villages, e.g. Barking dogs, crowing roosters, the sounding of prayer chants or are largely beyond our control. Consequently, Tanou cannot be held responsible for this.

6.7. Tanou is not liable for disruptions to travel and retreats due to force majeure (earthquakes, terrorism, storms, floods, accidents, etc.) or strikes that are unrelated to the organizer and the service provider.

  1. Confidentiality

As a service provider it goes without saying for Tanou and any vicarious agents to keep the data, concerns and personal information of the participants confidential.

  1. Data protection

8.1 The participant knows and agrees that Tanou will save the personal data required to process the order on data carriers. The participant expressly consents to the collection, processing and use of his personal data. The stored personal data will of course be treated confidentially by Tanou.

8.2 The participant has the right to revoke his consent at any time with effect for the future. In this case Tanou is obliged to delete the participant’s personal data immediately.

  1. One-to-one tuition

Appointments are binding. If an agreed appointment is canceled up to 24 hours in advance, 50% of the respective hourly rate is due. In the event of later cancellations, the full hourly price is due for payment.

  1. Communication

Communication by Tanou is generally carried out by email. For this purpose, participants must provide an email address when registering, which they call up regularly (at least once within 2 days). Unless otherwise stated, participants should also reply to inquiries sent by Tanou by e-mail.

  1. German law, place of jurisdiction, severability clause

11.1 German law applies.

11.2 Should individual provisions of this contract be ineffective or unenforceable or become ineffective or unenforceable after the conclusion of the contract, the validity of the rest of the contract remains unaffected. The ineffective or unenforceable provision shall be replaced by an effective and enforceable provision whose effects come closest to the economic objective pursued by the contracting parties with the ineffective or unenforceable provision. The above provisions apply accordingly in the event that the contract proves to be incomplete.
